Terms and Conditions (Updated 03/01/2011)

Horse Dynamics cc (hereinafter referred to as “The Yard”, which term shall include the owner of the property, owner of the horses and all staff)

I, the undersigned in my capacity as parent or legal guardian of the minor child hereby agree as follows:

1.    I acknowledge and accept that there are inherent dangers in horse riding and I fully understand the nature of the risk and the need for the rider to take all reasonable precautions.

2.    I accept and voluntarily assume the risk inherent in my child’s participation in horse-riding activities.  I, together with my child’s heirs, executors and administrators release Horse Dynamics cc, its officers, stewards, agents, grooms and representatives from any duty of care towards my child and from liability towards any claim that could accrue to my child or his/her heirs, executors or administrators arising from his/her participation in horse riding or any related activities, or of any loss of or damage to his/her property (whether physical, emotional and/or financial).

3.    Such horse riding activities will include but not be limited to riding, working with horses on foot or any other activity undertaken by participants in riding lesson.

4.    I further acknowledge that the use of a protective helmet is highly recommended.  In the event that I do make use of riding equipment provided by Horse Dynamics cc, Horse Dynamics cc management make no representations and give no warranty as to the fit of the said equipment, it is used solely at my child’s own risk.

5.    In the event of an accident involving my child there is no obligation on Horse Dynamics cc to secure for my child’s medical treatment, however I do hereby authorise Horse Dynamics cc to act in his/her best interest, which may include the obtaining of the necessary emergency medical treatment, which shall be for my account.  In such an event, Horse Dynamics cc will advise the contact person listed herein of the situation at the earliest possible opportunity but is authorised to secure medical treatment without prior consultation.

6.   We harbour horses and employ permanent assistants so as to provide the required basic facilities.  The expenses associated herewith are a constant, irrespective of weather conditions, illnesses and absence of school or holidays. Therefore, regardless of conditions in weather, illnesses, absence, holidays or cancellations of whatever reason, the quarterly tariff will be maintained.  Horse Dynamics cc will not be obliged to reschedule lessons lost as a result of any of the above mentioned conditions.  

7.    Therapy does continue, regardless of the weather conditions.  If the weather is too adverse to ride in, theory lessons are given.  End-of-the-year evaluation reports can be expected to communicate the rider’s progress with their parent/guardians.

8.     I agree that photographic and/or video material taken during activities may be used for training or marketing purposes.

PAYMENT SCHEDULE 2012

OPTION 1:

Annual Administration fee (once-off):  R150.00 (Includes a FREE Horse Dynamics bandana - while stocks last)

Quarterly Fees:  R549.00 per school term tendered only by EFT payment (No cheques or cash will be accepted) Note: 5% family discount applicable for 2^nd and 3^rd child

1^st Term: During 18 January – 30 March 2012 (Last day of payment 7 January 2012)
2^nd Term: During 10 April – 22 June 2012 (Last day of payment 7 April 2012)
3^rd Term: During 16 July – 28 September 2012 (Last day of payment 7 July 2012)
4^th Term: During 8 October – 7 December 2012 (Last day of payment 7 October 2012)

Quarterly fees are to be paid in advance within 7 (seven) days of the month of enrolling your child and subsequently before the 7^th (seventh) of the month of each new Gauteng public school term.  We are enforcing a strict “payment in advance” policy to all EFT clients.  Horse Dynamics cc reserves the right to charge interest on overdue accounts and/or cease offering therapy to the client.  Please refer to the debit order instruction form for an easy hassle free monthly payment option.

OPTION 2:

DEBIT ORDER INSTRUCTION FORM TO BE COMPLETED BY PARTICIPATING PARENTS OR LEGAL GUARDIANS

The R549.00 quarterly fee will be proportionally collected monthly.  If your child anticipates in therapeutic horse riding during the 4^th school term, the final debit order will be collected on the 24^th of December 2012.

Annual Administration fee (once-off): R150.00 (includes a FREE Horse Dynamics bandana - while stocks last)

Monthly fee by automated debit order: R183.00 per child (5% family discount applicable for 2^nd and 3^rd child)

I/we hereby request and authorise you to draw against my/our account with the abovementioned bank (or any other bank or branch to which I/we may transfer my/our account) the sum of R183.00 (one hundred and eighty-three-rand).  Debit orders are collected on the 27^th of each month or on the day prior to the 27^th in the event where the 27^th falls on a Saturday, Sunday or public holiday.  This being the amount necessary for the settlement of the monthly fee in respect of our enrolment and indemnity agreement.

All such withdrawals from my/our account by you shall be treated as though they had been signed by me/us personally.  I/we the undersigned, "instruct" and authorise your agent Netcash (Pty) Ltd, to draw against my/our account.  I/we understand that if bank details have been supplied the withdrawals authorised here will be processed by BankServ.  I/we also understand that details of each withdrawal will be printed on my/our statement.

I/we agree to pay any banking charges relating to this debit order instruction

The debit order will automatically be cancelled on the 24^th of December 2012 if no cancellation has been received. Please refer to the cancellations clause in this agreement.

CANCELLATIONS

To cancel this agreement before the 24^th of December 2012 and discontinue therapy, one full calendar month’s written notice from the first day of the month is required.  The parent/guardian of the child undertakes not to give notice of withdrawal during November and December (Regardless if the child is returning the following year).  The final date on which notice of withdrawal can take place is the 1^st of October for the end of October 2012.  Submit cancellations to us in writing and fax it to 086.655.3608 or e-mail it to info@horsedynamics.co.za.  (Please refer to www.horsedynamics.co.za  for the most up-to-date contact information.)
